Kiwan Law, P.C.
Effective Date: September 30, 2026
These Terms of Service ("Terms") govern your access to and use of https://www.kiwanlaw.com, including its content, forms, text-message features, and related online services (collectively, the "Website"). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
Article 1 — Informational Purposes Only
I. The Website provides general information about Kiwan Law, P.C. ("Kiwan Law," "we," "us," or "our") and selected legal topics. Website content is provided for general informational purposes only and does not constitute legal advice.
II. Laws and legal interpretations change, and Website content may not be complete, current, or applicable to your circumstances. You should not act or refrain from acting based on Website content without obtaining advice concerning your specific situation.
III. No Website content guarantees or predicts the outcome of any legal matter. Past results do not guarantee similar results in another matter.
Article 2 — No Attorney-Client Relationship
I. Accessing the Website, submitting a form, leaving a voicemail, sending an email or text message, or communicating with Kiwan Law does not create an attorney-client relationship.
II. An attorney-client relationship exists only after:
A. Kiwan Law has completed any required review and conflict check; B. Kiwan Law has expressly agreed to undertake the representation; and C. Kiwan Law and the client have entered into a written engagement agreement.
III. Unless Kiwan Law confirms otherwise in writing, no communication through the Website constitutes acceptance of a legal matter or an agreement to monitor or protect any deadline.
Article 3 — Confidential and Time-Sensitive Information
I. Do not submit confidential, privileged, highly sensitive, or time-critical information through the Website before an attorney-client relationship has been established.
II. Unsolicited information may not be protected by the attorney-client privilege and may not prevent Kiwan Law from representing another person whose interests are adverse to yours, subject to applicable professional obligations.
III. You remain responsible for monitoring and complying with all statutes of limitation, filing deadlines, hearing dates, response periods, and other deadlines unless Kiwan Law expressly accepts that responsibility in a written engagement agreement.
Article 4 — Text-Message Terms
I. Program Description. Kiwan Law may send text messages concerning possible clients or clients, including consultation responses, appointment reminders, case-related communications, administrative notices, and, if separately authorized, promotional communications.
II. Consent. By providing your mobile telephone number and affirmatively consenting, you authorize Kiwan Law and its text-message service providers to send messages to that number. Messages may be sent through automated technology where disclosed. Consent to receive marketing text messages is not a condition of obtaining legal services.
III. Frequency and Charges. Message frequency varies. Message and data rates may apply. Delivery depends on your wireless carrier and is not guaranteed.
IV. Opt-Out. Reply STOP to opt out of further messages from the applicable program. We may send one confirmation message. An opt-out request does not prevent communications that you separately request or that are reasonably necessary for an existing attorney-client relationship and otherwise permitted.
V. Help. Reply HELP for assistance or contact info@kiwanlaw.com or (805) 243-3462.
VI. Eligibility and Number Ownership. By enrolling, you represent that you are authorized to use the telephone number provided. You must notify us promptly if the number is reassigned, transferred, or discontinued.
VII. Message Security. Text messages are not guaranteed to be secure or confidential. Do not send sensitive information by text unless Kiwan Law has approved that method of communication.
VIII. Mobile Information. Mobile telephone numbers, SMS opt-in information, and consent records will not be sold or disclosed to third parties or affiliates for their own marketing or promotional purposes. Information may be disclosed to vendors that facilitate message delivery and program administration, including Twilio through MyCase.

Article 8 — Website Availability and Disclaimers
I. The Website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Kiwan Law disclaims warranties regarding the Website's accuracy, completeness, availability, security, merchantability, fitness for a particular purpose, and noninfringement.
II. Kiwan Law does not warrant that the Website will be uninterrupted, error-free, free of harmful components, or suitable for any particular legal or business purpose.
III. These disclaimers apply only to the Website and do not modify Kiwan Law's duties under an applicable written engagement agreement or governing professional obligations.
Article 9 — Limitation of Liability

Article 10 — Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Kiwan Law and its attorneys, employees, and agents from third-party claims, liabilities, damages, and reasonable expenses arising from your unlawful use of the Website, violation of these Terms, infringement of another person's rights, or submission of content you are not authorized to provide.
Article 11 — Privacy
Our collection and use of personal information through the Website are governed by the Privacy Policy posted above. If you become a client, additional confidentiality and information-handling terms may apply under your engagement agreement and applicable professional obligations.
Article 12 — Suspension and Termination
Kiwan Law may restrict or terminate access to the Website if it reasonably believes that a user has violated these Terms, created a security risk, interfered with the Website, or engaged in unlawful conduct. Provisions that by their nature should survive termination will remain effective.
Article 13 — Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising solely from use of the Website shall be brought in the state or federal courts located in Ventura, California, and each party consents to the jurisdiction of those courts, except where applicable law requires otherwise.
Article 14 — Changes to These Terms
Kiwan Law may revise these Terms periodically by posting the revised Terms with an updated effective date. Changes apply prospectively upon posting unless otherwise stated. Continued use of the Website after revised Terms become effective constitutes acceptance of those Terms.
Article 15 — General Provisions
I. Severability. If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain effective.
II. No Waiver. A failure to enforce any provision does not waive the right to enforce that provision or any other provision later.
III. Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement concerning use of the Website. They do not supersede or modify any written attorney-client engagement agreement.
IV. Assignment. You may not assign your rights or obligations under these Terms without Kiwan Law's written consent. Kiwan Law may assign these Terms in connection with a reorganization, transfer of the Website, or similar transaction.
